8. Links to major intellectual property Acts and sources of useful information

8.1  Primarily Acts of the Commonwealth Parliament govern intellectual property law in Australia. For a brief introduction about what each type of intellectual property involves, you should see the section above called "Intellectual Property - a General Guide". The relevant Acts are:

  Copyright Act 1968
Patents Act 1990
Designs Act 1906
Plant Breeder's Rights Act 1994
Trade Marks Act 1995
Circuit Layouts Act 1989

8.2  The law of confidentiality is not regulated by statute, although many statutes have an impact on disclosures such as the Freedom of Information Act 1982 (Commonwealth) and the Freedom of Information Act 1992 (WA). The government body regulating patents, trademarks and designs is IP Australia. Their website contains useful materials, particularly in providing a guide to the patenting process.
